These Terms of Service ("Terms") govern your use of the Podbotz website and services ("Service") operated by Caloroga Shark Media LLC ("Company," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing and using Podbotz, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use the Service.

2. Description of Service

Podbotz is a personalized podcast story generator that uses artificial intelligence to create original stories and audio narration based on user inputs. The Service allows users to:

Select from multiple story themes and genres
Customize story parameters including characters, settings, and tone
Generate AI-written stories
Generate audio narration of stories
Download story scripts and audio files

3. Account and Access

Access to the Service may require a password. You are responsible for maintaining the confidentiality of any access credentials.

4. Purchases

Stories are purchased individually through Stripe, our payment processor. You choose your story type and pay at the time of generation.
Prices are displayed before purchase. A single episode is $6.99 and a two-part story is $12.99.
All purchases are final. Due to the nature of AI-generated content, refunds are generally not available once a story has been generated.
Each purchase entitles you to one story generation with audio narration.

5. AI-Generated Content

All stories are generated by artificial intelligence and are original creations based on your inputs.
We do not guarantee that generated content will meet specific quality standards, word counts, or expectations.
Generated stories are provided "as is." While we strive for quality, AI-generated content may occasionally contain errors, inconsistencies, or unexpected material.
You receive a personal, non-exclusive license to use, share, and distribute any stories generated for you through the Service.

6. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Attempt to circumvent the payment system
Interfere with or disrupt the Service or its infrastructure
Use automated tools to access the Service without permission
Share access credentials publicly or commercially
Use the Service to generate content that is illegal, harmful, or violates the rights of others

7. Intellectual Property

The Podbotz name, logo, website design, and underlying technology are the property of Caloroga Shark Media LLC. Stories generated through the Service are provided to you under a personal use license as described in Section 5.

8. Third-Party Services

The Service relies on third-party providers including but not limited to Stripe (payments), Anthropic (AI story generation), and ElevenLabs (audio narration). Your use of the Service is also subject to the terms and policies of these providers. We are not responsible for the availability or performance of third-party services.

9. Limitation of Liability

To the fullest extent permitted by law, Caloroga Shark Media LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or related to your use of the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted on this page with an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
